NDPS Act Cases

NDPS matters are handled separately from ordinary criminal work because the statute imposes its own conditions on bail and its own procedural safeguards on the investigating agency.

How it ordinarily proceeds.

The usual course is set out below. Individual matters vary with the facts, the sections invoked and the court's board.

  1. 01
Quantity determinationWhether the recovery is small, intermediate or commercial quantity governs both the sentence exposure and the bail position. This is the first thing examined.
  2. 02
Compliance with the safeguardsThe Act and the standing instructions lay down requirements for search, seizure, sampling and the sending of samples. Non-compliance is a recognised ground of defence.
  3. 03
Bail applicationFiled before the Special Court, and thereafter before the High Court if declined. Section 37 applies where the quantity is commercial.
  4. 04
Trial before the Special CourtNDPS matters are tried by a designated Special Court. Cross-examination of the recovery witnesses and the chemical examiner is central.
  5. 05
AppealAn appeal against conviction lies to the Punjab & Haryana High Court, together with an application for suspension of sentence.

Common questions

Questions that come up.

What are small, intermediate and commercial quantity?

The Act notifies a threshold quantity for each substance. Below the small quantity threshold the sentence exposure is limited; at or above commercial quantity, Section 37 restricts bail and the sentence range is substantially higher.

Is bail possible in a commercial quantity case?

It is not barred, but Section 37 requires the court to record satisfaction on the conditions in that section. These applications are argued on the material on record and on the compliance position.

What are the common defences?

They turn on the facts, but frequently involve compliance with the statutory procedure for search and seizure, the handling and sealing of samples, and the chain of custody.

Which court hears NDPS matters at Patiala?

The designated Special Court under the Act at the District Court, Patiala. Appeals lie to the Punjab & Haryana High Court at Chandigarh.
